- What is a “Trademark Renewal”?A “Trademark Renewal” consists of two different documents that must be filed with the USPTO after a trademark has been registered in order to keep the trademark alive and well. The first document is called a Section 8 Declaration of Continued Use and it must be filed twice after the trademark has been registered. The second document is called a Section 9 Renewal and it must be filed numerous times after the trademark is registered
- When do I need to renew my trademark? The Section 8 Declaration of Continued Use is due between the fifth and sixth year of registration and again between the ninth and tenth year after registration. The Section 9 Renewal is due between the ninth and tenth year after registration, and every ten years after that (calculated from the registration date).
- Can I make changes to my registered trademark when I renew it.No.
- How much does it cost to renew a registered trademark? The USPTO charges a $250 per class of goods/services to process a Section 8 Declaration of Continued Use and $550 per class of goods/services to process a Section 9 Renewal. In addition to the government fees, our firm charges a professional fee of $299 per class for either the Section 8 filing or the Section 9 filing (or the combined Section 8 and 9 filing).
- What happens if I do not renew my trademark? If you do not renew your trademark for whatever reason, your trademark will become abandoned, and you will lose it.
- I failed to renew my trademark. What can I do to preserve my trademark rights? To preserve your trademark rights, you will need to either revive your abandoned trademark registration or file a new trademark application.
